Marital property division
All assets accumulated during your marriage, with the exception of gifts and inheritances, must be divided fairly. In Connecticut, we call this "equitable division," though equitable does not necessarily mean fifty-fifty. If one side has significantly more assets and earning power than the other, the family court may consider an unequal division to be equitable. The courts may also order alimony and child support in certain instances.
One emotional issue for many divorcing couples is who will get the house. If the parent with primary child custody can afford it, he or she will probably get the house. However, that does not mean he or she will get to keep the equity in the house. Equity in a house, like other marital assets, is usually divided.
Child custody and child support
Child custody is often a pivotal issue in divorce. Connecticut law will consider the best interests of the child in determining which parent will have primary residential custody. In determining the child's best interests, the court will consider issues such as which parent has been the primary caregiver, which parent offers a more stable environment and which parent is most likely to respect the visitation rights of the other parent.
Prenuptial Agreements
In Connecticut, prenuptial agreements are becoming an increasingly popular way to determine in advance how property will be divided in the event of a divorce.
These agreements are growing in popularity as both husband and wife now have earning potential and therefore bring assets into a marriage. A prenuptial agreement is a contract like any other. In order to be enforced, however, it must comply with Connecticut law. Once requirement is that both parties had an opportunity to speak to their own lawyer prior to signing it.
